Teacher Eligibility Test (TET)To be Held on 29/03/2014 by School Service Commission Stayed By Court Orders

As per Times Of India News Source dated March 21,2014(21/03/2014) the Teacher Eligibility Test (TET) to be conducted by West Bengal Central School Service Commission (WBSSC) scheduled on March 29,2014  is stayed by Court orders.

Calcutta High Court on Thursday  stayed the Teachers' Eligibility Test (TET) scheduled on March 29,2014.
Petitioners Santanu Biswas, Animesh Mondal and others have challenged a state government circular dated January 29 this year that allowed all applicants for these jobs to appear for TET, irrespective of whether they had a BEd degree or not. The petitioners also questioned the government decision of not issuing TET qualified certificates to those who had cleared the test earlier. Guidelines of the National Council for Teachers' Education (NCTE) require the state to issue these certificates with a seven-year validity, the petitioners contended. Further, they alleged that the circular was confusing.

Responding to the petition, Justice Debashish Kar Gupta issued the stay order on the School Service Commission (SSC) and fixed April 21 as the next date of hearing.

Appearing for the petitioners, Shamim Ahmed argued that his clients had cleared the TET in 2012. In spite of a standing NET circular, the government refused to issue his clients a TET certificate.

According to the petitioners, allowing candidates without BEd was a violation of a ministry of human resources development (MHRD) notification. Appearing for Mondal, Sudipto Dasgupta pointed out that though the Right of Children to Free and Compulsory Education Act requires all teachers of classes V to VIII to have BEd, the MHRD had given a relaxation on this requirement till March 31, 2014. Hence, though the state could allow candidates without a BEd degree to appear for TET, the SSC would have to complete recruitment by March 31 to comply with the MHRD notification. The petitioners had argued that with this year's TET scheduled on March 29, it would be impossible for SSC to meet the criterion.
